PRIVACY POLICY - Information document Article 13 EU Regulation 2016/679 - GDPR - Information on the processing of personal data collected from the interested party.
 

In compliance with the provisions of EU Regulation 2016/679 (European Regulation on the protection of personal data), we hereby provide you with the necessary information regarding the processing of personal data provided. This information does not apply to other websites that may be accessed through links on the owner's domain websites and the owner cannot be held responsible for third-party websites.
This information is provided in accordance with Article 13 of EU Regulation 2016/679 (European Regulation on the protection of personal data) and is also based on the provisions of Directive 2002/58/EC, as updated by Directive 2009/136/EC, regarding Cookies, as well as the provisions of the Provision issued by the Italian Data Protection Authority on 08.05.2014 regarding cookies. Personal data that can be processed: "personal data" means any information relating to an identified or identifiable natural person ("data subject"); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that person (C26, C27, C30).

Specific information may be provided on the pages of the Website regarding particular services or data processing activities.

1. DATA CONTROLLER, pursuant to Articles 4 and 24 of EU Regulation 2016/679, is ESAPEL S.p.A., Via Bioli n. 18, 36072, Chiampo (VI), VAT number: 01235840244, email address info@esapel.com, represented by its legal representative pro-tempore.
 

2. PURPOSE AND LEGAL BASIS OF PROCESSING


The provided personal data will be processed, in compliance with the conditions of lawfulness under Article 6 of EU Regulation 2016/679, for the following purposes:

- possible contact request, with the sending of requested information
- legitimate interest (Article 6(1)(f)) as the legal basis for processing;
- to respond to a specific information request through the form on the "contact" page;
- to respond to specific information requests sent voluntarily to the email address info@esapel.com, located in the footer and contact area of the website.


3. RECIPIENTS OR CATEGORIES OF DATA RECIPIENTS


The provided personal data will be disclosed to recipients who will process the data as data processors (Article 28 of EU Regulation 2016/679) and/or as individuals acting under the authority of the Controller and the Processor (Article 29 of EU Regulation 2016/679), for the purposes listed in point 2 above. Specifically, the data will be disclosed to: entities that provide services for the management of the information system used by Esapel S.p.A. and the telecommunications networks; freelancers, firms, or companies within the scope of assistance and consultancy relationships; entities that provide services for the management of the information system used by Esapel S.p.A. and the telecommunications networks, including email and website management; competent authorities for compliance with legal obligations and/or provisions of public bodies, upon request.
The entities belonging to the aforementioned categories act as Data Processors or operate independently as separate Data Controllers. The list of Data Processors is constantly updated and available by writing to info@esapel.com or at the registered office of Esapel S.p.A.


4. DATA RETENTION PERIOD OR CRITERIA FOR DETERMINING THE PERIOD


The processing will be carried out in an automated and manual manner, using methods and tools aimed at ensuring maximum security and confidentiality, by specifically authorized individuals. In compliance with Article 5(1)(e) of EU Regulation 2016/679, the personal data collected will be stored in a form that allows the identification of data subjects for a period not exceeding the purposes for which the personal data are processed. The retention of provided personal data depends on the purpose of the processing:

For contact requests (maximum 1 year); the timeframe is determined based on criteria that the data subject can obtain by writing to info@esapel.com at the registered office of the Controller.


5. NATURE OF THE PROVISION AND REFUSAL
 

Except as specified for navigation data, the user is free to provide personal data. The provision of data is optional or necessary depending on the specific purpose for which the data is processed. Failure to provide data marked with the symbol* will make it impossible to obtain the requested information or to use the services of the data controller. 6. THE PROVIDED DATA WILL NOT BE TRANSFERRED OUTSIDE THE EUROPEAN UNION Personal data will not be transferred to countries outside the European Economic Area (EEA).


7. RIGHTS OF DATA SUBJECTS


You can exercise your rights as expressed in Articles 15, 16, 17, 18, 19, 20, and 21 of EU Regulation 2016/679 by contacting info@esapel.com. You have the right, at any time, to request access to your personal data, their rectification, erasure, restriction of processing, and portability, where applicable. Furthermore, you have the right to object, at any time, to the processing of your data based on consent and/or legitimate interest. Without prejudice to any other administrative or judicial remedy, if you believe that the processing of your data violates the provisions of EU Regulation 2016/679, in accordance with Article 15(f) of the aforementioned EU Regulation 2016/679, you have the right to lodge a complaint with the Italian Data Protection Authority (Supervisory Authority www.garanteprivacy.it).
